1Scope

This Privacy Policy explains how Marfa Field Guide (“we,” “us,” or “our”) collects, uses, discloses, and retains personal information when you use marfafieldguide.com, submit a form, build or share an itinerary, subscribe to our email list, or otherwise contact us, collectively referred to as the “Site.”

This Policy applies to the free Site.

If you separately hire an event-planning company after submitting a Plan an Event inquiry, that company’s agreement and privacy practices may also apply to the client relationship.

2Who Is Responsible for Your Information

3Information You Provide

Event, Correction, and Contact Forms

When you submit an event, correction, inquiry, or message, we collect the information you choose to provide.

This may include your name, email address, the type of inquiry, and a short message.

We use this information to review the submission, respond, request clarification, update the Site, prevent abuse, and maintain appropriate records.

Plan an Event Inquiries

When you use the Plan an Event page, we collect the information submitted through the form.

We use it to understand and respond to your request. The inquiry may be shared with [INSERT EVENT-PLANNING LLC LEGAL NAME], the separate event-planning business through which the Site operator may offer freelance planning services.

Submitting the form does not create a client relationship.

If you later enter a planning contract, information collected for that engagement will be governed by the contract and any privacy notice provided for that business.

Newsletter Subscriptions

If you subscribe to the newsletter, we collect your email address and any other information you voluntarily provide through the subscription form.

We use Flodesk to manage subscribers and send email.

Newsletter subscription is voluntary and separate from all other forms. Submitting an event, correction, contact message, or planning inquiry does not subscribe you to marketing email.

Privacy Requests and Correspondence

If you contact us about this Policy or exercise a privacy request, we collect the information necessary to understand, verify, and respond to the request.

4Itinerary Information

The itinerary builder may process trip dates, approximate arrival and departure times, general arrival route, selected interests, pace, preferences, selected stops, edits, and generated itinerary content.

Under the recommended Site design, a saved itinerary is stored locally in your browser using local storage. It is not attached to an account and is not intentionally stored in a Marfa Field Guide database.

You can remove it by using the Site’s delete or start-over controls, clearing Site data in your browser, or clearing your browser storage.

If you create a share link, the itinerary is encoded in the portion of the link after the # character and is processed by the recipient’s browser.

Anyone who receives or gains access to the complete link can view the trip details contained in it. Do not share the link with someone you do not trust.

We design share links to exclude names, email addresses, form messages, precise lodging addresses, and other direct identifiers.

A shared link may remain in your browser history, clipboard, messages, email, or any service through which you share it. Those services have their own privacy practices. You are responsible for deleting copies from those services when desired.

5Information Collected Automatically

When you access the Site, our hosting provider and other technical service providers may automatically process standard connection and request information.

This may include an IP address, browser type, device type, operating system, referring page, pages requested, timestamps, and security or diagnostic information.

This information is used to deliver, secure, maintain, and troubleshoot the Site.

The Site also keeps anonymous, aggregate measurements of how its own pages are used, so we can tell which listings and sections readers actually reach. This is our own tool, running on our own hosting. Nothing is sent to an advertising network, an analytics company, or any other third party.

What is measured: the page path being viewed, a broad screen-size band (phone, tablet, or desktop), where on the page clicks land, how far down the page a visit scrolled, and the visible text of any link or button that was clicked.

What is not measured: no cookie, no visitor or session identifier, no fingerprint, no IP address, no keystrokes, no form contents, and no recording or replay of your visit. Each measurement is added straight into a running total and is never stored on its own, so there is nothing left that could be traced back to an individual visitor or linked from one page to the next.

We honor the Do Not Track and Global Privacy Control browser settings. If your browser sends either one, nothing at all is measured. You can also turn measurement off for this browser here:

We do not currently use Google Analytics, Meta Pixel, targeted advertising trackers, session-replay tools, or similar behavioral-advertising technology.

If this changes, we will update this Policy and, where required, provide appropriate notice or choice.

6Local Storage, Cookies, and Similar Technology

The Site may use browser local storage or similar technology to remember an itinerary, selected preferences, interface state, or acceptance of Site terms.

If you turn off page measurement using the button in Section 5, that choice is also stored in this browser's local storage, so that we can honor it on your next visit. Clearing your browser storage will clear that choice along with everything else.

This information remains on your device unless you share it or your browser or device synchronizes it.

Netlify, Flodesk, the embedded Marfa Public Radio player, and their technical providers may use cookies or similar technology when you interact with their services.

Their use is governed by their own policies. You can control cookies and Site storage through your browser settings, but blocking essential storage may prevent some features from working.

7How We Use Information

We use information to:

• Provide, maintain, secure, and troubleshoot the Site.
• Generate, save, edit, print, copy, and share itineraries as requested.
• Review and respond to events, corrections, contact messages, and planning inquiries.
• Publish or correct community information.
• Send newsletters to people who affirmatively subscribe.
• Prevent spam, fraud, misuse, and security incidents.
• Comply with law and protect our rights and the rights of others.
• Understand general Site operation without targeted advertising.

8How We Disclose Information

We do not sell personal information.

We do not use or disclose personal information for targeted advertising, and we do not accept advertising or paid placements.

We may disclose information in the following limited circumstances:

• Netlify: Hosting, Site delivery, security, and form processing. If Netlify Forms is used, form submissions are stored in the Netlify account until deleted.
• Flodesk: Newsletter subscription management, email delivery, opt-in records, engagement information, and unsubscribe processing.
• Marfa Public Radio and its player provider: Delivery of the embedded audio player when you load or use it.
• [INSERT EVENT-PLANNING LLC LEGAL NAME]: Only when needed to review or respond to a Plan an Event inquiry or continue a planning conversation you requested.
• Professional advisers and contractors: When reasonably necessary for legal, accounting, technical, security, or operational support and subject to appropriate duties.
• Legal and safety disclosures: When reasonably necessary to comply with law or legal process, enforce our terms, investigate misuse, protect rights or safety, or respond to an emergency.
• A future organizational transaction: If responsibility for the Site is transferred, reorganized, or combined with another operation, subject to applicable law and notice.

9Third-Party Links and Embedded Content

The Site links to independent businesses, venues, ticketing services, social-media accounts, maps, and other websites.

It also includes an embedded Marfa Public Radio player.

When you follow a link or interact with embedded content, the third party may collect information directly from your browser or device.

This Policy does not govern those third parties. Review their privacy policies before providing information.

Hover is the registrar from which the Site’s domain was purchased. Domain registration alone does not make Hover a recipient of every visitor’s Site activity. Any direct interaction you have with Hover is governed by Hover’s own policies.

10Email Choices

You may unsubscribe from marketing email at any time by using the unsubscribe link in a message.

Flodesk may retain a limited suppression record so that an unsubscribed address is not inadvertently added again.

Unsubscribing from marketing does not prevent a direct response to a message or planning inquiry that you initiated.

11Retention

We retain personal information only as long as reasonably necessary for the purposes described in this Policy, including responding to requests, maintaining records, preventing abuse, complying with law, and resolving disputes.

Our intended retention practices are:

• Saved itineraries remain in your browser until you delete them or clear browser storage.
• Shared itinerary data remains wherever you or a recipient keeps the link. Marfa Field Guide does not intentionally maintain a server copy under the recommended design.
• Event, correction, and general contact submissions may be retained for up to 12 months after the last relevant activity, unless a longer period is reasonably necessary.
• Unconverted Plan an Event inquiries may be retained for up to 24 months after the last relevant activity.
• Information for contracted planning work may be retained longer under the separate business’s contract, tax, insurance, and legal obligations.
• Newsletter information is retained while you remain subscribed and afterward as needed to maintain an unsubscribe or consent record.
• Technical and security logs are retained according to the applicable service provider’s settings and policies.

12Your Choices and Privacy Requests

Depending on where you live and applicable law, you may have rights to request access to, correction of, deletion of, or a copy of certain personal information, and to withdraw consent or appeal a decision.

You may also ask questions about our practices.

Send requests to hello@marfafieldguide.com. Describe your request and the email address or submission involved.

We may need to verify your identity before acting. We will respond within the period required by applicable law. We will not discriminate against you for exercising an applicable privacy right.

Because saved itineraries are stored locally in your browser under the recommended design, we generally cannot access, retrieve, or delete them for you. Use the Site controls or your browser settings.

13Security

We use reasonable administrative and technical measures appropriate to the nature of the Site and the information we handle.

No website, transmission, or storage system is completely secure, and we cannot guarantee absolute security.

Do not send sensitive personal information through the Site.

14Children

The Site is intended for a general audience and is not directed to children under 13.

We do not knowingly collect personal information from children under 13.

If you believe a child has submitted personal information, contact us so we can review and delete it as appropriate.

15Visitors Outside the United States

The Site is operated for a Texas-based guide.

If you use the Site from outside the United States, information processed by us or our providers may be transferred to and processed in the United States or other locations where those providers operate.

Privacy laws in those locations may differ from those in your jurisdiction.

16Changes to This Policy

We may update this Policy when the Site, our vendors, our storage design, or applicable law changes.

We will post the revised Policy with a new effective date.

If a change materially affects how we use information already collected, we will provide additional notice or obtain consent when required.
